FAQ

  • When do I need a lawyer?
    • Depends on what sort of case you have. Often civil matters should get lawyers involved before any contracts, or agreements have been entered into to ensure the process is conducted properly. In criminal matters, a lawyer should be appointed as soon as police are involved. In our experience, we suggest you do not go to any interviews without a lawyer present.

  • What's the difference between a Jury Trial and a Judge-Alone Trial (JAT)?
    • You can elect a Jury Trial in some circumstances. The key difference is that in a JAT the Judge is the only person who makes all the decisions, whereas in a Jury Trial the jury are the people who make a determination on the facts of the case, and the Judge assists with the law.   • When am I entitled to Legal Aid?
    • Our firm does both Criminal and Civil Legal Aid and is approved at the top level for both. Legal Aid is dependent on an income based application. Not everyone will be entitled to Legal Aid. Although for civil matters, you can choose a legal aid lawyer, your requirements to obtain legal aid are not only financial but will also require your lawyer/legal representative to elaborate on the key elements of the case and possibilities of success. This is then left to the discretion of the Legal Aid officer to determine legal aid.

    • In Criminal matters, if you are charged with a charge categorised as PAL 1 and 2, you cannot choose a lawyer when applying. However for PAL 3 and 4 cases, you are able to decide.
